Our in-depth expertise in debt-related matters enables us to advise lenders and borrowers in a wide range of financial transactions.  We represent national, regional, and community banks; investment banks; insurance companies; loan servicers; and factoring companies.

As borrowers' counsel, our attorneys have significant experience in structuring loan transactions and in the review, assessment, and negotiation of loan documentation.  For lenders, we advise our clients regarding loan origination and documentation, loan servicing, syndication, workouts, foreclosures, litigation, receiverships, and creditor rights in bankruptcy.

Frequently, we are engaged as bond counsel, underwriters' counsel, and letter of credit bank counsel in public financing transactions including general obligations, revenue bonds, and tax-exempt conduit financings.  We also assist local governments in structuring and implementing economic development projects.  We help pave the way for many different kinds of financial transactions.

Privacy and Data Security Counseling
Sussman Shank has advised numerous small and large companies concerning their rights and obligations under state, federal, and international privacy and data security laws.  These include the Financial Privacy Act (federal and California), Gramm-Leach-Bliley Act, Fair Credit Reporting Act, Fair and Accurate Credit Transactions Act, FTC's Privacy Principles regulating online advertising, and data breach laws.
