WCP has grown from a family-run river barge company into a full-service concrete/aggregate supplier with multiple locations. As WCP’s business has expanded, our construction and business attorneys have worked alongside WCP’s management and staff to support its operations, protect its interests, and strengthen its contracts and credit practices.
Like many businesses in the construction industry, WCP depends on timely payment for the materials it delivers to its customers. To help ensure WCP gets paid in a timely manner, Sussman Shank has provided ongoing guidance on contract terms, account documentation, and enforcement strategies—including the filing of construction lien and bond claims.
Recently, our team helped WCP secure an interest in a delinquent customer’s assets. When the customer failed to pay as promised, our attorneys enforced WCP’s secured interest by compelling direct payment from the customer’s client of money owed by the client to the customer. In addition, we enforced various construction liens recorded by WCP. As a result of this teamwork and proactive approach, WCP was able to recover the vast majority of the money it was owed by the customer.
