COVID-19: Construction Industry - Updates for Oregon and Washington

Construction Industry Stakeholders:

We hope that you are remaining safe and well in these challenging times. As you likely know, Governors Brown and Inslee have each issued executive stay at home orders for Oregonians and Washingtonians, respectively. Each order may have different effects on specific businesses. Under either state's executive order, for construction industry businesses to remain open, they must adhere to certain social distancing and safety measures. If your company is experiencing impacts from the Coronavirus on any project, we recommend you review the contracts for those projects to determine if they allow your company to request additional time to perform and/or monetary damages and, if so, what notices must be issued to preserve those rights. Often times such provisions require notices to be given within a certain number of days and if not timely issued, all rights are waived.
