Professional Experience
Timothy A. Solomon is an associate at Sussman Shank LLP in the Bankruptcy Department.  Mr. Solomon has represented debtors, creditors, committees and trustees in some of the largest and most complex bankruptcy cases in the country.  Notable matters have included, among others, the successful reorganization of a major satellite imaging company; obtaining a $45.5 million cash settlement in an avoidance action on behalf of a committee of unsecured creditors after extensive discovery, motion practice, briefing, and mediation; and obtaining full dismissal of all claims against a large hedge fund/co-defendant in a $1.1 billion avoidance action.

Tim's experience extends to all major aspects of bankruptcy law, including issues relating to:

• determination of property of the debtor's estate
• the use of cash collateral
• professional carve-outs
• debtor-in-possession financing
• the automatic stay
• assumption and rejection of executory contracts
• determination of the validity and priority of liens
• section 363 asset purchases and sales
• setoff and recoupment
• the avoidance and recovery of fraudulent and preferential transfers 
• proofs of claim and claim objections
• equitable subordination
• plans of reorganization and liquidation
• the appointment of chapter 11 trustees
• corporate governance issues; and
• the fiduciary duties of committees, directors, and officers

Tim also has significant experience in general commercial litigation, including trademark, breach of contract, civil assault, and professional negligence cases.

Before joining Sussman Shank LLP, Tim was an associate at Latham & Watkins LLP and another major law firm in New York City.
